Roz Bienvenu Argues at the New Mexico Supreme Court
Congratulations to Santa Fe partner Roz Bienvenu, who presented argument in the New Mexico Supreme Court on September 4, 2025.
Working with trial counsel from Arnold & Itkin, Roz argued on behalf of Plaintiff-Petitioner Jesus Moreno in a case addressing New Mexico's savings statute, which provides a plaintiff six months to refile a case that has failed for any procedural reason other than negligence in prosecution. However, New Mexico case law has not yet addressed how this savings statute operates when a plaintiff's initial case is filed outside of New Mexico under that state’s different statute of limitations. Roz presented arguments underscoring that the savings statute should be liberally construed to achieve the important goal of facilitating the resolution of disputes on their merits.
